Let's Wait 'til Somebody Sues Us

Maybe you're wondering why so many first-time candidates like myself are emphasizing that there has never been a more important time to bring change to Manchester's City Hall ... well, here's Exhibit A:

Alderman Ted Gatsas, a leading proponent for residency requirements, suggested the board could ask a judge to say whether the proposal is constitutional. When (City Solicitor) Clark told him the board does not have the authority to make such a request, Gatsas replied, "Then let's wait 'til somebody sues us."

I understand the residency proponents' arguments - they are valid and in many ways I agree with them. For example, I see no reason why the Board of Mayor & Alderman could not simply incentivize city officers and department heads to reside in Manchester whether through contractual provisions like early retirement or pension bumps, thereby giving them specific reasons to live within city limits. It's innovative, pragmatic and, best of all, it's legal.

There's one BIG problem though with the Gatsas/BMA vote ... IT'S WILDLY UNCONSTITUTIONAL!!!!!!!! I may be an attorney, but any first year law student could have told that to Alderman Gatsas.

So now the same Board that sought the City Solicitor's legal advice on the tax gap gimmick blatantly ignores it on the residency issue. Make no mistake about it - when the city now has to crack down on non-resident officers, the City of Manchester WILL get sued thanks to Ted Gatsas wanting another political gimmick to exploit with the election less than a month away. The cost to Manchester taxpayers in man hours and legal fees will be significant, but hey, sue us!!!! We double-dare you ... it's not like our Aldermanic Board swears to uphold the law and is the steward of the people's money, right?

ENOUGH IS ENOUGH!

Good for Mark Roy for standing up for the constitution and for Manchester taxpayers. I urge N.H. Democrats and progressives to support Mark and first-time candidates like myself who have had enough of the petty, political foolishness emanating from Manchester City Hall. And if you can't donate money, please take some time off on November 3rd to help right the Queen City ship.

It does seem to be legal to require that emergency services (0.00 / 0)
personnel live in or in close proximity to their employment as a condition of employment.  It's not possible to impose that retroactively and it's questionable that it's even enforcible if circumstances mitigate against compliance after hiring.

Inviting a civil suit is totally irresponsible.  He's vitiated any defense if a suit is filed by, in effect, admitting that whatever he wants to do is probably illegal.

There's a reason why the discussion of legal strategy with the city's attorney is exempt from the public hearing requirement.  In blabbing to the press, Gatsas is giving away the company store.  Of course, it's not HIS money, so what does he care?

This "my way or the highway" style of governing is ridiculous.

What's the point of asking the city attorney for his professional opinion if we are just going to ignore him - simply because Ted Gatsas doesn't like the answer?  

What happens if, for example, a department head lives in Manchester, but then gets divorced and moves in with his or her parents in an abutting town like Hooksett or Bedford? Are we going to fire the person? How much will the city spend defending that case?  

Add this to the fact that Hooksett may pull its high school kids because Gatsas's budgets have decimated our schools, and Gatsas's desire for an expensive and unnecessary charter review. We'll go broke.

Manchester can't afford Ted Gatsas as mayor.

Oh, and how about this irony: Gatsas is pulling in tens of thousands of dollars in donations from his wealthy special interest friends who don't live in our city. I guess what is good for the goose is not good for the Gatsas.

If the best person for a particular job doesn't live within city limits, Ted Gatsas thinks we shouldn't hire them?  That's not an efficient use of taxpayer funds.  And if you're going to have a tax cap, efficiency is key.

Also, we shouldn't have a tax cap.

"If you weren't born here, raised here, educated at Central/West/Memorial/Trinity, etc, then you have no place in public life".

The talk about dedication to the community and so forth sounds nice, but it's really window dressing. The folks pushing for this restriction are the classic good old boys and girls, parochial, insular, and resistant to the possibility of change.

I want the best person in every position. I don;t care if that person sleeps in Derry or Pembroke or Candia. I'm not concerned about zip codes; I'm concerned about competence and character.

The same statement came out of the Aldermanic Chambers when the aldermen were discussing not funding MCTV to their contractual obligation...Just go ahead and pass a budget that breaks a contract and let MCTV sue the City for the funds that MCTV is suppose to get per contract. But when MCTV obtained legal council and threatened to sue, the statement "MCTV is wasting tax payers dollars" was then stated in the Chambers. What a freakin' mess Guinta and most of the Board have created in Manchester!
