Tobin Cleared Just as Prosecutor Purge Scandal Reaches Phonejamming Case

Unbelievable scandal convergence today on the phonejamming saga. The conviction of phonejamming strategist James Tobin has been overturned:
The U.S. Court of Appeals for the First Circuit in Boston ruled that the statute under which Tobin was convicted "is not a close fit" for what Tobin did and questioned whether the government showed that Tobin showed an intent or purpose to harass.

Read that paragraph carefully, folks.  I'm not a lawyer, but to me, that sounds like the prosecutor messed up.  Accidentally on purpose?

I wouldn't make light of it if this didn't come right on the heels of the NHDP pressing for a new investigation into why it took sooo long for the Justice Dept. to pursue indicting Tobin:

"Why did it take so long for the indictment against Mr. Tobin to be brought?" she asked. "His name was apparently out there and known to the Department of Justice for several months and yet nothing was done with him until after the 2004 election."

Sullivan said a request to the Senate Judiciary Committee, led by Democratic Sen. Patrick Leahy of Vermont, should go out in a day or two.

This stinks to high heaven, folks.  It's obvious that something is rotten here, and it is poisoning justice in our state.  This needs to be addressed by Congress NOW.

Update #4: Here's a thought: so is this why Sununu was the first to call for Gonzo's head?  Getting out ahead of this early before it utterly ruins his re-election chances?

STATEMENT FROM KATHY SULLIVAN ON TOBIN DECISION

CONCORD, NH - The following is a statement from State Party Chair Kathy Sullivan on the decision for the First Circuit Court of Appeals to remand the case against former Republican National Committee Northeast Regional Director James Tobin to the district court for further proceedings:

"We are disappointed in the court's decision that the jury instructions were not sufficient. We expect that when the case returns to New Hampshire the Department of Justice will vigorously pursue the prosecution and conviction of Mr. Tobin.  The Court did find that nothing precludes a rational jury from concluding that Tobin was a conspirator or that he knew and agreed to the general means of the disruption of Democratic Party phone lines.

This decision will not have any impact on our request for an investigation into whether political considerations played a role in Department of Justice decisions relating to this case.

"The National Republican party has invested millions of dollars defending James Tobin, but we believe that despite their best efforts to continue stonewalling the phone-jamming scandal, justice will be served."

Specifically -- where would Todd Hinnen be involved, where would USA Tom Colantuono be involved?

But whether Ashcroft's, and later Gonzales', involvement was unusual or not, Democrats say that the need to check decisions with DoJ higher-ups routinely resulted in "inordinate delays" in the investigation. They also say that both AGs failed to recuse themselves, despite a conflict of interest: Ashcroft as a former senator, since Tobin was a high ranking official in the committee that helped Ashcroft get elected; and Gonzales as legal counsel for the White House, since the Democrats alleged White House involvement in the jamming scheme.

The Democrats' other grievances, which they lay out in the letter, are 1) that the Justice Department bogged the investigation down by assigning only one FBI agent to the case -- and that agent was part-time 2) that the DoJ's refusal to prosecute the organziations responsible for the jamming, the New Hampshire Republican Party and the Republican National Committee, violated Justice Department guidelines, and 3) the DoJ failed to follow leads that led to higher-level Republican involvement.

This sucks to high hell. Then again this CAN'T be over. The blogs, Internet media, etc. need to keep bringing this story to the light and it works.

Look at the success Josh Micah Marshall had with his constant coverage/blogging/whatever on the "Gonzalez 8" scandal. His persistence in examining the issue paid off and I think it would've had a tougher time sticking with the MSM if he wasn't a part of it. So it's not over yet.

Besides... if the Boston Red Sox can come from behind in beat the New York Yankees in seven games, then truly ANYTHING is possible.

Basically, Tobin's  defense got a brand new bite of the apple, as the Appeals Court let them broaden their earlier (false) claim that phone "harassment" must imply frightening phone calls, into a claim that phone harassment implies broader kinds of emotional distress.

The Appeals Court said that the phone "harassment" statute wasn't meant to outlaw a denial of service attack.
