My Oath of Office

As required by Article 6 of the U.S. Constitution, Members of Congress are bound to support the Constitution. We take the following oath: "I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter."

As the representatives of the American people, our job is in many ways quite simple: to "support and defend the Constitution of the United States against all enemies, foreign and domestic." There's no question in my mind that Democrats were given a majority in both the House and the Senate based on their promises to change the course of the country.  We were elected to strengthen the nation by ending this war, restoring our standing in the world and returning the nation to an adherence to the rule of law.  An integral part of that mandate was to reverse and stop the Bush Administration's assault on the Constitution.

Yet, we today are faced with the possibility that the Senate will see a renewal of the Foreign Intelligence Surveillance Act that enables the Bush Administration to broadly eavesdrop on American citizens and provides for retroactive immunity for telecommunications companies that helped them violate civil liberties and the law.

The Constitution of the United States belongs to the American people, not to the Bush administration. It is our responsibility as Senators and Congressmen to stand up and fight for it.

That's why I announced last week that I would put a "hold" on any FISA reform legislation that includes retroactive immunity for telecom companies -- and why, if my hold is not honored for some reason by the Senate Leadership, I pledge to filibuster to stop telecom amnesty from becoming law.

The need to honor our oath of office isn't limited to defending the Constitution. Anyone who has paid attention these last five years knows that there is no military solution in Iraq.  We will be more safe and more secure when we get our troops out of Iraq. To continue on this failed course, to continue to fund our involvement in Iraq's civil war is, in my opinion, a dereliction of our oath of office as well.

The path forward is clear: it's time for Congress to set a date certain for withdrawal from Iraq and tie it to funding. If I could, I'd say we start bringing our troops home tonight to the heroes welcome they deserve. At the same time, we have to act to defend the rule of law and support the Constitution.

The truth is, I never thought I'd be running for President on a platform of restoring the Constitution  and America's standing in the world or something as elementary as honoring the oath of office we take. But with our security at risk, we haven't any other choice. I haven't forgotten the words I first uttered on January 4th, 1975 and I will dedicate myself to support and defend the Constitution of the United States against all enemies, foreign and domestic until I take the oath of office on January 20, 2009  - this time, as the President of the United States. I hope you'll stand with me and ask your Senators to do the same as they consider further funding for the war in Iraq and retroactive immunity for telecom companies.

I just got home after an exhausting day 12 hour-day at work... reading this I'm invigorated again.

I'm ready to march.

I still remember that debate where they said to you "First 100 days of office, what do you do"

I was ready to scream at the TV, and then you replied

"I'd try to restore the constitutional rights in our country. This administration has done great damage to them. I would do that on the first day. I wouldn't wait a hundred days on those issues."

And I remember you had said something similar at Peter Flood's house party -- but that made me take notice, that the answer came so easily to you.

I'm glad to see this is your fight. Iraq and the erosion of our civil liberties were the issues that pushed me into becoming more politically active in the 2006 election -- they are what got me blogging politically in the first place. You are really unrivaled in your defense and understanding of those issues -- and whatever the outcome of this primary you've done a great service with the way you've pushed these....

Not supporting either candidate. Trying to make sure Hillary is on our side, and that Obama knows sides matter.

It is entirely fitting that you should come here to write about your defense of the Constitution, and your work to restore it, since that is precisely the issue that, along with your correct approach to ending the Iraq war, and your insistence on a corporate carbon tax, clinched my vote for you.

And in a week in Congress that, frankly, has been dispiriting to Democrats, your hold on the FISA bill, and promise to filibuster it brightened my spirits and many others who care about the basic rule of law in this country.

When I saw you way back in January at Peter Burling's house, I was impressed by the vigor with which you opposed the "surge."  Your leadership on the critical issues we face has only become stronger since then.  Thank you.

Wonder if Sununu's fired now.

I caught about 10 minutes of it on the fly. I think Dod would poll much better if the debates weren't so lopsided.

He did come out strong in Hanover, hands down.

(Aside: I thought Biden was "clean and articulate" ;v) on This Week yesterday.)

Dodd is doing a great job keeping the  Abuse of Executive Power on the front burner. Kudos!

He has let holds on other issues stand - even when the holds might well have fallen to a cloture vote.

What is the logic for not honoring this hold?

And look who's skyrocketed up the latest dKos straw poll, ahead of Obama even. 

And this from the Nation via the Telegraph:

Dodd is not known for radical procedural maneuvers or filibustering. He vocally opposed last year's unconstitutional Military Commissions Act, for example, but accepted pleas from Democratic leaders not to filibuster it. Last October, Dodd said he regretted that decision.

Now, facing a recalcitrant and secretive Administration, Dodd says he will not make that mistake again. "I rarely put holds on things. I can't remember the last time I ever did. I'm not in the habit of filibustering," he said. "There has been this constant drumbeat of erosion of constitutional rights, under the false dichotomy that we have to make a choice, as a people, [that] to be more secure we have to give up rights. And I fundamentally disagree with that concept.... The accumulation of it is stunning to me. And candidly I'm a little disappointed that the Democrats would agree to this [surveillance bill]," Dodd explained during a Friday meeting with the Nashua Telegraph editorial board.
