NH House Says No to Barring Guns from Schools

by: William Tucker

Sat Apr 09, 2011 at 15:53:54 PM EDT

Yesterday afternoon, I had the following text message exchange with my thirteen year old son:

Him: Schools on lockdown.
Me: Whats up?
Him: Apparently a psychopath is in the school.
Him: According to someone in my homeroom who was just downstairs someone has a gun.

It turns out there wasn't an armed psychopath in the school, just a man exercising his "natural right" to walk by a school full of children with a rifle in one hand, a handgun strapped to his leg, and a belt of ammunition slung over his shoulder.

The man did not violate any New Hampshire state laws. If he had been a psychopath intent on committing mayhem, he would not have been in violation of state law until he pulled the trigger.

The Gun Free School Zones Act is a federal law that prohibits possession of firearms within 1000 feet of a school. The New Hampshire House considers this an unconstitutional intrusion. 240 state representatives voted in favor of HB 125, a bill that would bar the enforcement of federal gun laws on New Hampshire-made weapons.

This is lunacy.

I understand (0.00 / 0)
that by the new Liberty-speak, a place where guns are banned is a "killing zone," while a place where guns are allowed is "safety zone."  They are just trying to make our schools safe.  Just buy your 13 year old a gun and all will be well.

While they're nullifying everything, (4.00 / 2)
they could care less if a few school children and teachers are "nullified" as well. Especially the teachers.

Looking forward to nullifying their terms of office in 2012.

2012. Or sooner, in some cases.

For inquiring minds who want to know, (0.00 / 0)
here is the House Roll Call on HB 125.

It is worth looking at those listed as Not Voting as well as those voting Yea or Nay.

Frank Case voted N (0.00 / 0)
Duarte, Reagan, Sullivan (J) and Tasker voted Y

That's not a shocker n/t (0.00 / 0)

[ Parent ]
Sean Coughlan of Amherst didn't vote (0.00 / 0)
...which should be no surprise given that he's missed 58% of votes so far.

added penalty (0.00 / 0)
Federal law prohibits possession of firearms within 1000 feet.

HB 125 would not only bar the enforcement of Federal gun control laws, but would make it a criminal offense for law enforcement to do their job.

Meaning...

If a School Resource Officer acted to uphold the 1000 foot prohibition, they could be charged with a Class A misdemeanor for doing their job if the weapon was made in NH.

(And should there be a Federal employee involved, they would be charged with a felony)

Correction... (0.00 / 0)

240 state representatives voted in favor of HB 125, a bill that would bar the enforcement of federal gun laws on New Hampshire-made weapons.

239 Republican state representatives voted for this insanity, and one lone Democrat, some guy named Gimas who regularly votes Tea Party.

K. Umberger voted nay on HB-125 (0.00 / 0)
It appears that another Republican, Karen Umberger from Carroll County, also voted nay.  She has been surprisingly independent lately.  I think she wants to run for the senate in 2012.

[ Parent ]
Umberger's not independent (0.00 / 0)
when it counts. She voted for that lousy budget. To her credit, however, she always returns my calls - which is more than I can say for the Speaker Para Tempura, or whatever Chandler's non-title title is.

[ Parent ]
Time for the parents of the school children (0.00 / 0)
to file Federal suit.  They'll win.

No state law can nullify Federal law.  NH Republicans are no match in any case.
