The Next 96 Hours VITAL For Marriage Equality

by: Rep. Jim Splaine

Fri May 08, 2009 at 07:40:53 AM EDT

Right now, it's Friday morning.  The next 96 hours are vital for getting your word to Governor John Lynch to support House Bill 436 for marriage equality. By then he might have the bill on his desk.

IF this bill doesn't become law, it won't be before 2011 that we can do this, and that might be difficult even then.  We have to do this now.

So, PLEASE -- Even if you have already written to or called Governor John Lynch, do so again.  If you haven't please do it now.

If you've already sent an E-Mail, today -- CALL.  If you have already called, please -- WRITE A LETTER -- put a stamp on it and mail it.  Today.

If you can please drop by the State House during the next few days and visit his second floor office -- the door is always open.  Drop in and ask to see the Governor, or a staff member.  He might have time and he enjoys talking with visitors.  Or leave a note with the receptionist that you came by.

Office of the Governor
State House
25 Capitol Street
Concord, NH 03301
Telephone:  (603)271-2121
FAX:  (603)271-7680

Or, to send an E-Mail visit http://www.governor.nh.gov/con...

If you are gay or lesbian, send him your picture, tell your story.  If you know someone who is gay or lesbian, tell him about them.  Let him know we ALL count, and should be treated equally.

Visit the NH Freedom To Marry WEBSITE for other ideas:  http://nhftm.org/

Whatever you do, PLEASE DO IT NOW.  Governor John Lynch can make up his mind anytime on signing House Bill 436.

After he makes his decision, your words of advice won't matter.

We can do this.  Equality.  2009.  Let's bring it home.

Robo Calls? (0.00 / 0)
Have there been any against Marraige Equality?
A guy I know made this site to track them nation wide http://robocall.twibune.com/
You can go directly or report through Twitter.
It's a great tool and I hope activists/people use it more in order to track possible shady things happening in the last 96 hours.

yes I got robocalls (0.00 / 0)
from Cornerstone. I think it is time we investigated this group and their funding and their behavior.

Make Sure to Report it! (0.00 / 0)
The link its above. It's really quick.
It's important that Robo Call information is aggregated in order to respond accordingly.

[ Parent ]
I reported, but not very many people seem to use this (0.00 / 0)
As far as I can see on that site I am the first person to report a call since November. There have been numerous waves of robocalls in NH last few months.

=Health care for all now!=

True but... (4.00 / 1)
After seeing a few posts about robo calls, It's utility just dawned on me. If more people use it we'll be able to see where in the state they are targeting, the content of the robo call, and who sponsored it. We'll see how it goes I guess!

Breaking News...NH PUBLIC: 64% SUPPORT MARRIAGE TO ONLY BE
ONE-MAN, ONE-WOMAN

Over the last two days, CPR-Action surveyed EVERY HOUSEHOLD IN NH - that's right, 432,398 households - and asked a simple question:

Do you agree that marriage between one man and one woman should be the only legal definition of marriage in NH? The results?

64% of the New Hampshire public said "YES". Republicans, Democrats, and Independents have sent a clear message: do not re-define marriage in New Hampshire!

You are doing a GREAT job of flooding the Governor's Office with calls - but he needs to hear from ALL of you until he makes a decision!!

PLEASE CALL GOVERNOR LYNCH TODAY AT 271-2121 AND TELL HIM TO KEEP HIS WORD BY VETOING HB436!

=Health care for all now!=

and as I recall to start with (0.00 / 0)
I think that may not have been exactly the question they asked in that call.

=Health care for all now!=

[ Parent ]
I heard from people (4.00 / 1)
that they were asked "Do you believe marriage between one man and one woman should be legal?".

[ Parent ]
yes, that was more like it (0.00 / 0)
if I am recalling. So of course anyone who thought those marriages should (also) be legal would say yes. And they were robocalls, at least what I got was a robocall.

=Health care for all now!=

[ Parent ]
You'd think they would be smarter (0.00 / 0)
they could have arranged a vaguely reputable poll—at least reputable enough for there to be "conflicted" polling in media reports—but instead they claimed to have surveyed EVERY HOUSEHOLD IN NH. It's a transparent gimmick, when they could have used essentially the same robocall to also gin up something that would get more public play.

Or perhaps they were afraid of the results....if they could only get 64% to say yes to their misleading robocall :)

Come on, Gov, I need a Mothers' Day gift for my mom!

I did get a push poll (0.00 / 0)
I did get a robotic push poll which was centered a very confusing question: I forget the exact wording, but it was a multiple-negative question designed to make it virtually impossible for you to come out in support of HB436.  The basic idea was that anyone who was in favor of heterosexual marriage would say "Yes"--- and I am pretty sure 99.9% of the NH population-- gay, straight or otherwise--- thinks heteros should be allowed to marry.

I did go ahead and say "No" anyway.

The caller ID says the call from "CAMPRES09" at 1-202-461-3460

Hate to seem like a broken record but (0.00 / 0)
I encourage you to report it here...

It would be nice to see the robo-calling unfold in real time and to be able to compare the content of the different push polls.

The map apparently isn't updating immediately as of now, but the database is.

Great memory and detail Timothy. That's really helpful.

could not believe (0.00 / 0)
we are planning a 40th HS reunion in October so I joined Classmates.com(against my better judgement) because that's how it is being organized.
There was a banner ad with the Gov.'s pic and a message by the group claiming Lynch promised to not sign...sheesh

"Poetry is not an expression of the party line. It's that time of night, lying in bed, thinking what you really think, making the private world public, that's what the poet does." Allen Ginsberg

That's absurd. (4.00 / 2)
I'm sure we'll see even worse things in the upcoming days.

I will be calling today (4.00 / 2)
In support of both the gay marriage and medical marijuana bills.

So: stupid question #1 from Elsie (0.00 / 0)
"By then he might have the bill on his desk."

I realize the clock starts ticking on whether or not the bill will pass into law without his signature when the bill is presented to him.

Er...when is that, exactly? When do we start counting?

I'm kind of taking the "no news is good news" approach -- that if the governor were intent on a veto, he would have already spoken to that effect. I'm also completely aware that this is a potentially completely false hope.

Possibly By Tuesday (0.00 / 0)
House Bill 436 could physically get to his desk perhaps by Tuesday.  It could be longer.  The State Senate passed HB 437, the Civil Unions bill, on April 26th, 2007; he decided to sign it on May 31st, almost five weeks later.  It can take a while for the logistics.

BUT, he could decide to sign or not anytime, so please get those letters, E-Mails, visits, phone calls, and FAXES going to him.  He needs to hear from his friends.  Now.

[ Parent ]
Question (0.00 / 0)
How long after it reaches the Governor's desk does he have to either sign it, or not sign it and let it become law?

[ Parent ]
Five days (0.00 / 0)
calendar days, excluding Sundays.

[ Parent ]
excluding Sundays (4.00 / 1)
I assume that is an archaic Christian specific rule...
My religion holds that the Sabbath is from sundown Friday to sundown Saturday, so am I being theoretically discriminated against ? As long as we are talking separation of Church and State, let's make it faith neutral...every day counts, or none should.

"Poetry is not an expression of the party line. It's that time of night, lying in bed, thinking what you really think, making the private world public, that's what the poet does." Allen Ginsberg

[ Parent ]
Actually... (0.00 / 0)
I don't think they mentioned anything in the specific language about why not Sundays, just that Sunday doesn't count in the five days (though yes, the Christian origin is not hard to figure out). It'd be pretty tough to push through an amendment to the NH constitution without something with more impact on people's lives. Currently the only person with standing to sue would be the governor; nobody else is restricted by the five-days rule.

IT for John Lynch '04 and NHDP '08 - I'm liking my track record so far!

[ Parent ]
It impacts my life every day (4.00 / 1)
Gone are the days when only white male Anglo Saxon Protestants could serve in NH's State House, but only gone in the early 20th Century...Blue laws, meeting dates, they all assume that everyone has the same religious preference or bows to one, the Christian faith. Every time we have a convention on a Saturday I feel discriminated against in a subliminal way.
I don't see this as any less discriminatory than basing the idea of marriage on religious principles. When you take religion out of the Marriage Equality equation it quickly breaks down to

http://www.bluehampshire.com/s...
Either we want to discriminate, or we don't.  Either we're for equality, or we're not.

When you take Christianityy out of the equation then Sunday is like any other day. You can choose to worship then or on Wednesday.
So,why do we still allow one religion's preference to dominate our secular lives? It is not in the Constitution, in fact I would bet that Jefferson would agree with me, that it is the majority imposing it's will on a minority who is trained to go along to get along. Thankfully at least Chinese restaurants are open on Christmas. :)

[ Parent ]
Legally, though... (0.00 / 0)
That's where I meant you'd have a tough time proving standing without being the governor. You'd probably have better results making a political push to remove religious references from the constitution altogether via amendment, rather than going through the courts.

IT for John Lynch '04 and NHDP '08 - I'm liking my track record so far!

[ Parent ]
what if he calls in The Speaker and Senate Prez (4.00 / 1)
and says something like..."I can only sign with these changes, which assure equal protection, so that the Bill would stand up to a challenge in Court" or something to that effect. I believe there is a provision in State law that would allow them to go back to their bodies and Amend, and/or correct or improve to get his signature. Who knows if that is correct>

"Poetry is not an expression of the party line. It's that time of night, lying in bed, thinking what you really think, making the private world public, that's what the poet does." Allen Ginsberg

[ Parent ]
HB 436 Is Complete (0.00 / 0)
House Bill 436 is complete, not open to further amendment, having passed both the House and Senate -- except for the most technical of changes such as periods or commas or small typos.  That's where it stands at this point, the "Enrolled Bills" process.

However, there are other bills still to be acted upon which if there was something such as a technical oversight that needed to be corrected or adjusted, we could easily do that in another statute.

House Bill 436 does the job, and we can always create enough "What If's" to question any bill.  We can make this work, or we can find ways to raise questions.  The fact is, throughout the 8-month process of writing this bill, and amending it, and throughout the 11 hours of public hearings and dozens of hours of discussion in House and Senate Committees, this rather simple bill has been well-considered.

Either we want to discriminate, or we don't.  Either we're for equality, or we're not.

It is a process question, not a setup, Jim. I know because I asked Bresler this question on the phone, earlier today.

Picture from Concord Rally for Marriage Equality (0.00 / 0)
There is another Bill in the Senate for this very reason, in case other flaws are discovered. See,you go to rallies, you learn things! Jim I am not being a downer, but I know the Governor will be doing a close reading of the Bill, because he believes that is his job, before he can sign it. He not only has a degree from Harvard in Business, but a law degree from Georgetown. He well knows the challenges that will come. He has as much right as either body in our bi-caneral system to look at Legislation before he signs it. In such a historic case, that's the right thing for him to do.

Thank you! (0.00 / 0)
Will we know when the bill is presented? I've done some looking, but not found anything definite about rules.

[ Parent ]
No one should beg for their freedom (4.00 / 2)
I am a pro-life Catholic who believes marriage is between a man and a woman.  And I support this bill's passage wholeheartedly.
No one dies.  No one's civil rights are infringed upon.  A piece of paper is provided to two people who want public recognition of their committed relationship.  I don't have to agree with the relationship to agree with the right.

At this point Lynch's silence is insulting to gay people.  Frankly, I find it insulting as well.  I don't think anyone should call at this point.  I think Lynch should know his career is on the brink if he doesn't act immediately.

Otherwise, gays have to snivel before the "king" begging for their rights.

Don't do it.  Let him ruin himself, but don't beg for something you know always should have been yours.

Woo! Great point Dave. (0.00 / 0)
You inspired me to call Gov. Lynch right now.

[ Parent ]
Dave Makes Good Points, But... (4.00 / 2)
...we need to let the Governor know our feelings.  This is part of the process.  We don't have to "beg," but we can express our views.  We do so at all levels of government.  Our elected leaders need to know the viewpoints of their constituents.

[ Parent ]
I completely misread that! (0.00 / 0)
Dave you had me on a roll! Rep. Splaine is absolutely right, we have to call! We need to pop that Concord bubble Gov. Lynch is in and make sure he knows how his constituents feel.

Also, if Lynch and his staff are so heartlessly wrapped up in this from a political standpoint, and are considering the political repercussions, his future career, etc etc...the man had a 76% approval rating...Governor Lynch I think you have some political capital to spare! Sign the bill!

[ Parent ]
He's dangling you (0.00 / 1)
Governor Lynch is currently engaged in a game of cold shoulder.  He wants everyone to know how much he loathes that this legislation has reached him.  And the gay community in New Hampshire is being dangled in front of the Right Wing like meat in front of wolves.
If you call Governor Lynch let him know you understand exactly what he's doing and that you find it extremely insulting.  I think it is shameful.
It's a passive agressive attack on gay and lesbian New Hampshire and on those politicians that put the legislation before him.
You are not victims and you did nothing wrong.  So please don't suck up to this guy any more.

As that may be... (4.00 / 1)
...a polite approach is always the best, after all, this is politics, I hope, and NH still requires a jacket in the legislature. :)

The state constitution has laid out a perfect path if Gov. Lynch loathes the legislation, but finds it politically inexpedient to veto it; he can simply ignore it into law, and I think that would be just fine with everyone.

Constituents who support the bill can and should let the governor know their strong support for either signature or pass. It's not sucking up to do so politely -- it's good politics. We attract more flies with honey than vinegar, and we always make our case more strongly in the affirmative than with threats and negativity.

I very, very much hope this bill becomes law.
