The Republican argument in favor of same sex marriage

Bush's Solicitor General Ted Olson and Republican lawyer David Boies, who represented Bush in the US Supreme Court to win the 2000 election, are filing a suit in Federal Court to overturn Proposition 8.

Boies, in an op-ed article in today's Wall Street  Journal writes: "Recently, Ted Olson and I brought a lawsuit asking the courts to now declare unconstitutional California's Proposition 8 limitation of marriage to people of the opposite sex. We acted together because of our mutual commitment to the importance of this cause, and to emphasize that this is not a Republican or Democratic issue, not a liberal or conservative issue, but an issue of enforcing our Constitution's guarantee of equal protection and due process to all citizens."

I thought this would be snarky, from the title (0.00 / 0)
There really is a very strong alignment between marriage equality and some fundamental Republican values.  Issues of state vs. individual rights and federalism - at least re: DOMA - seem to mean that a lot of Republicans should be supporting gay rights.

I'm glad Ted Olson has stepped forward. I'm a little bit puzzled that more Republican legislators in the Live Free or Die state did not.

For the record, I absolutely think marriage equality is a constitutional right and would like nothing more on this issue than to see SCOTUS strike down the bans in the remaining 44 states.

But I don't think Chief Justice Roberts, Justice Scalia, Justice Thomas, Justice Alito, and Justice Kennedy will agree, and I'm concerned that if the court hears such a case now and does not do the right thing, it'll be a long time before we get another chance for them to do so.  In fact, my understanding is that this very concern is the reason why groups like ACLU and the Human Rights Campaign have refrained from this approach thus far.
