HB1590- An Act Repealing Marriage Equality

As I begin, this diary, the vote on the Judiciary Committee Report on HB1590 is being taken. The Judiciary Committee voted 12-8 that this bill is Inexpedient to Legislate, that is, it should be killed.

Interestingly enough, it is usual for the person writing the blurb, or report for the House Calendar to be the one to speak to that position on the floor. Rep Nancy Elliot(R-Merrimack)was glaringly absent from today's debate. At this point, she's said enough, and it's been broadcast around the world.

Jennifer Daler :: HB1590- An Act Repealing Marriage Equality
The first speaker on this motion was Rep John Cerbrowski (R-Bedford). He compared marriage equality to the fantasy play of his grandchildren. He claimed marriage is only for procreation. He said that civil unions is the special legal protection for gay and lesbian couples. Separate but equal, in other words. Then he talks about respecting people's rights, unaware he is disrespecting them. Oh well.

Then Rep Thompson(D-Manchester) spoke, somewhat personally. He also said conservatives should support marriage equality, because marriage is the basic building block of society, leading to stability for the community. He asked how his marriage has impacted anybody else's.

Next up: Jordan Uhlery (R-Hudson) who babbled somewhat incoherently about John Locke and "natural law". All I know is what he said did not jive with my foggy memory of classes, both in high school and college on Locke, Hobbes, Berkely and Hume, but that is a function of misinterpretation rather than lying, at least. Then he said we're all supposed to be breeding as many children as possible. I guess he doesn't believe in birth control or that people who are heterosexual, but choose not to have children should be married, either. Medically infertile couples are also out of luck, as are elderly folks who may want to remarry after being widowed or divorced. He also stated civil unions would be "good enough".

Ed Butler (D-Hart's Location) gave an eloquent speech, also from personal experience. He will be married on April 14 to his long time partner and civil union partner. Much love and happiness to you both Ed!

Then...it's Al Baldasaro (R-Londonderry) who said in the first 30 seconds that a person can change his or her sexual orientation. It kind of goes on from there. He also expounded on "natural law". Did they all have a Locke study group or something? Speaker Norelli had to bring him back from a tangent about last year's vote. And, just as with CACR 28--We'll be back....

Lucy McVitty Weber (D-Walpole) made three points: civil unions were repealed when marriage equality took effect, and there isn't a provision in HB1590 to bring them back. Some churches actually support same sex marriage, so it is an infringement on religious freedom to do away with it. And lastly, she spoke of an elderly lesbian couple who have been partners for years and after marriage equality passed told her: Now we feel like human beings. She asked, "how can you take that away?

A roll call was requested and the PI's were done b y Al Baldasaro against the committee report and Gary Richardson for the committee report,

The committee report to kill the bill was upheld 210-109.

Now, how can we not organize to keep our Democratic majorities in this state? The anti-equality forces will be back and will keep coming back as long as they see this as an opportunity for their own political purposes.

A lesbian couple from my UU congregation were married last week, because they were afraid that they might not have the opportunity if they waited until May, as they'd planned.

This vote means that gay and lesbian couples can put that fear aside, and enjoy the chance to plan and marry as they wish.

Thank you, NH legislature, for showing the rest of the country that we are not a state full of bigots.

Gay and lesbian state workers in Virginia are no longer specifically protected against discrimination, thanks to a little-noticed change made by new Gov. Bob McDonnell.

McDonnell (R) on Feb. 5 signed an executive order that prohibits discrimination "on the basis of race, sex, color, national origin, religion, age, political affiliation, or against otherwise qualified persons with disabilities," as well as veterans.

It rescinds the order that Gov. Tim Kaine signed Jan. 14, 2006 as one of his first actions. After promising a "fair and inclusive" administration in his inaugural address, Kaine (D) added veterans to the non-discrimination policy - and sexual orientation.

So for those burnt out, impatient and otherwise unhappy with progress at the federal level, please, please please organize your state house districts, state senate districts, town committees.

If Dems do not keep the majority in the NH House and Senate, all progress will be rolled back, and with a vengeance.

Rep Baldasaro noted in both debates that these bills will be back in January 2011. And  I take him at his word.

Can these thugs be sued for harassment when they continue to threaten to take these civil rights away?  Why should our glbt friends and family have to worry year after year that what progress they've gained could be taken away by neocons like Baldasaro, Elliot, and Urley?

here is the roll call.  but i agree that it was pathetic (but fitting) that Cebrowski was the first speaker on the bill she wrote the blurb for.  i can't think of a more fitting alternate to "wiggling it around in excrement" Elliott than the insanely derisive "cruel joke" and "false satisfaction" Cebrowski.

Many Anti-marriage Republicans and Democrats voted "yea" today (4.00 / 1)
A quick perusal of the roll call showed that there were quite a few anti-marriage Republicans and Democrats who voted in favor of marriage equality today. Very interesting

I'm sure Jim or someone else will have a more extensive analysis later.

This is encouraging - these State Reps do not want to take away our rights.

3 out of 4 state reps voted against this bill. Only one of the three had voted for marriage equality last year - Rep. Ed Butler.
Democrat Tom Buco voted for equality today, as did GOP Rep. Karen Umberger.
Only Gene Chandler was enough of an ideologue to vote against Ed Butler's upcoming marriage.

He's a small, small man.

40 Republicans... (4.00 / 7)
...joined almost all Democrats in opposing the gay marriage repeal bill.  That should put a rest to the far, far right in their "cause" to continue trying to sell their bill of goods to the people of New Hampshire.  This is not an issue for November.  Imagine:  210 to 109.  Most got it:  300 gay and lesbian people now have marriage licenses since January 1st and under our state laws they are equal to all our other New Hampshire citizens who have marriage licenses.  That's The New Hampshire Way.

That margin of victory -- 2-1 -- took lobbying and hard work by many.  Our fellow Legislators were organizing to stop these bills way back in late November, and we had the help of outside groups and supporters from last year's victory on House Bill 436.  The Democratic Leadership did a great job, and House members heard from www.BlueHampshire.com readers and many others.

A great job by our speakers, and by the House Judiciary Committee and Dave Cote, the Committee Chair.  I'll have more to write soon.  We have lots of people to thank, just like we did after the votes last March - June.  Reminding them all that we appreciate their support will help widen our victories on any future attack bills.  

We got here by showing OUR faces and telling our stories.  We'll stay where we are and continue to improve equality of rights for all by keeping our Legislative Majority for years to come.
