Show Us Your Papers.... in NH?

Note: This is diary #2 in a one-week series of diary posts leading up to this Friday's Immigrants Day rally in Manchester, hosted by the NH Alliance for Immigrants and Refugees. Post #1 is here.

So, Arizona's Governor signed that crazy "show your papers" bill into law, underscoring the need for comprehensive immigration reform. Without federal action, the President and the Congress should expect a whole lot more of these misguided and extreme state based laws. The federal government needs to stand up and lead and fulfill their responsibility to lead on immigration. We don't need anymore band-aid fixes for our broken immigration system - NH urgently needs comprehensive immigration reform this year.

Think that can't happen in NH? Folks have actually already tried.  Remember what happened in New Ipswich?  Or in Hudson? Did you know that there was even a similar resolution by Reps Ulery and Renzullo, but it was turned on it's head by State Rep. Kris Roberts earlier this year? Despite still having the anti-immigrant State Representatives names on it, the resolution is now
headed for the State Senate's Judiciary Committee this week.  Spare one small segment, our group supports this resolution, as it now urges comprehensive immigration reform.

Comprehensive immigration reform is a much better fix for America, as it gives a pathway to citizenship to undocumented immigrants (that isn't an amnesty), accounts for a future flow of immigrants, eliminates bureaucratic backlog of visas and citizenship applications, and accounts for enforcement.

Here's what's doubly cool: IMMIGRATION REFORM IS OF ECONOMIC BENEFIT TO THE AMERICAN ECONOMY! According to the Center for American Progress & the CATO Institute,
comprehensive immigration reform that includes a legalization program for unauthorized immigrants and enables a future flow of legal workers would result in a large economic benefit-a cumulative $1.5 trillion in added U.S. gross domestic product over 10 years. In stark contrast, a deportation- only policy would result in a loss of $2.6 trillion in GDP over 10 years.

So, to circle back on Arizona, wanted you to have a few more talking points about it:

The Arizona Law Has Triggered a MORAL Crisis. This new law has turned Arizona into 1960's Alabama. Families will be under siege, parents will be afraid to send their children to school, and workers will be afraid to report to their jobs. In the United States of America, no one should have to be afraid to walk down the street because of the color of their skin. This law is anti-Latino, and tramples on the civil rights of ALL Arizonans.

The Arizona Law Has Triggered a POLITICAL Crisis. Arizona's new law has effectively declared open season on the state's Latinos.  The fastest growing segment of the electorate will be paying attention. They want to know who stands for finally fixing the broken immigration system and who stands for draconian measures like the one passed in Arizona this weekend. As Meghan McCain said this week "The concept that a law-enforcement official can stop an individual when "reasonable suspicion exists that a person is an alien, who is unlawfully present in the United States" is essentially a license to pull someone over for being Hispanic.... and once again Hispanic voters in Arizona have yet another reason to distrust the Republican Party"

How To Take Action On Comprehensive Immigration Reform

Please fax NH's Federal Delegation today and tell them you want them to support immigration reform and that you want it to pass this year. Or sign our pledge.

Join us on Friday, or maybe even at the State House on Wednesday for the hearings at the State Senate Judiciary Committee.

That undocumented people will become targets of criminals. No victim of crime, without the proper proof of residency, will dare speak with the police.

Witnesses to crimes will not come forward.

There will be a wall erected. Not along the US-Mexican border, but between law enforcement and residents.

That will only help criminals.

And that ALREADY is happening across the country.

Weather it's unscrupulous employers, abusive partners, and even human trafficking exists in America today, thanks to this underground and broken immigration system.  

Arizona's wrong-headed measures are absolutely not a fix to the problems.  Only comprehensive immigration reform can bring to light our underground economy.  The millions of hidden and undocumented people will finally be able to come out of the shadows.

It's for them that we must fight.

Terry Goddard Leads Jan Brewer In Arizona Gov's Race: Hispanic Voters Flocking To Democratic Candidate

State Attorney General Terry Goddard (D) leads Republican incumbent Gov. Jan Brewer in Arizona's 2010 gubernatorial election, according to a new survey from Public Policy Polling released on Tuesday.

The poll finds Goddard ahead of Brewer 47 percent to 44 percent in what is becoming an increasingly competitive match-up. An earlier poll from several weeks ago found the candidates to be locked in a tight contest, highlighting a dramatic shift in the race since last fall when the Arizona governor held a 10-point lead over her Democratic challenger.

Hispanic voters also appear to be flocking to Goddard -- his support among that group has more than doubled since September. Hispanics prefer Goddard over Brewer by a 71 percent to 25 percent margin, according to the poll.

The new poll comes in the aftermath of Brewer's decision to enact a controversial immigration bill into state law making it a crime to be in the country illegally

This week, Arizona signed the toughest illegal immigration law in the country which will allow police to demand identification papers from anyone they suspect is in the country illegally. I know there's some people in Arizona worried that Obama is acting like Hitler, but could we all agree that there's nothing more Nazi than saying "Show me your papers?" There's never been a World War II movie that didn't include the line "show me your papers." It's their catchphrase. Every time someone says "show me your papers," Hitler's family gets a residual check. So heads up, Arizona; that's fascism. I know, I know, it's a dry fascism, but it's still fascism.

This is just an FYI and I'm throwing it out here for discussion. Don't piss on the messenger.

Apparently, the federal immigration program 287(g) started by Bush and expanded by Obama, is the model for Arizona SB 1070 anti-Immigrant law. Check this link out.

I'd be curious to hear what you have to say about that.

Obama should stop it.
But Obama is decidedly NOT for what happened in Arizona with 1070.

You should also know that the Obama Administration is looking into options to stop what's going on in Arizona after 1070: http://www.latimes.com/news/na...

And you should know that the real solution to all of this is COMPREHENSIVE IMMIGRATION REFORM, for which President Obama has voiced support, as has Senator Jeanne Shaheen and Senator Judd Gregg.  

I love the point that the President made at a town hall in Iowa recently:

President Obama said at an Iowa town hall meeting today that the controversial immigration legislation signed into law Friday could lead to racial profiling.

"You know, you can try to make it really tough on people who look like they, quote, might be illegal immigrants," he said.

The president added that a Hispanic American whose family had been in the United States for generations faced a situation in which "now suddenly if you don't have your papers and you took your kid out to get ice cream, you can be harassed, that's something that could potentially happen."

"That's not the right way to go," the president said, calling the law "poorly conceived."

Sounds to me like President Obama isn't supportive of what's going on in Arizona. So, no, I don't think that Arizona based what it wrongly did from anything related to President Obama's stands on immigration reform.

Immigrants are people in a foreign land who intend to (0.00 / 0)
come to the U.S. to take up permanent residency.  People who only want to come briefly, but don't have enough money to rent a car and stay at a hotel and need to work to pay their way are not immigrants.  They are migrants and, migration being a normal attribute of mobile creatures, exercising a natural and human right.
For the U.S. to make laws that govern the behavior of people who aren't even here yet --i.e. the residents of other nations --just in case they want to come here, is an exercise in incredible hubris.
Moreover, since there is not a universal permit to work system (requiring permits for normal, non-hazardous behavior would be un-Constitutional), subjecting non-citizens to such a permitting procedure would violate the equal protection clause which demands that all PERSONS receive equal treatment.  So, if work permits are going to be required, they will have to be required of all persons seeking to work for pay.  Slaves will probably be exempt.

A license to drive is different because an engine driven vehicle is a potentially deadly machine and operators need to demonstrate that they are capable to do so safely.

About this NH bit--it's my understanding that to get a new NH driver's license one has to show either a birth certificate or citizenship papers.  That's why I chose to renew my driver's license in Georgia.  There is no valid reason for NH to question my citizenship or identity.  Our society is organized so that a person is presumed to be honest until proven otherwise and innocent until found guilty.  Suspicion doesn't merit being honored.

This whole citizen-non citizen schtick is an effort by the segregationists to find some reason to exclude some group, any group for some non-sensical reason.  There is to be no discrimination on the basis of national origin.  The phrase is "national origin" not "nationality."  Indeed, several of the detainee cases decided by the Supreme Court have established that the Constitution applies to how our agents of government treat people, even when they encounter them abroad.  The Constitution is addressed to our agents of government's behavior.  It does not either enumerate individual rights nor establish conditions for human rights not being honored, with the sole exception that individuals suspected of criminal behavior (having caused harm to another) may be detained, charged and tried in a court of law.

The question we need to ask is why entirely inoffensive individuals should be treated with less respect for their human rights (including mobility) than individuals about whom there is reason to suspect their having done harm.  Crossing a border (an arbitrary line on the ground) and working for pay or spending what was earned somewhere else are not harmful behaviors.  Shutting people out is as onerous as locking them in.  The only difference is that we are proposing to do to others what we don't want done to ourselves.

What if George W. Bush were suddenly told he can't enter Spain?  Oh, wait, hasn't somebody charged him with war crimes? Bad example.

In defiance of the new bill in Arizona and in support of the Arizona citizens who will face harassment every time they step out their doors, the call is out for everyone to ask the question: "Do I look 'illegal'?" for the full day of May 1st.

Post the question as your status on Facebook. Throughout the day, send the question out on Twitter. Ask one another the question, "Do I look illegal?" Hopefully, this will get all of us thinking and discussing what exactly does "illegal" look like..

Finally, wear shirts, buttons or hold signs saying, "Do I look "illegal"? and take pictures to either send to Governor Jan Brewer of Arizona and/or post them here..

This law is not only most likely unconstitutional, but opens the door to visual profiling. It substitutes paranoia and suspicion for due process and probable cause. "If you look foreign, we can check your papers." "If you look African-American, we can pat you down for a gun." "If you look like a hippie we can search you." This is not only an attack on illegal immigrants, for which it aims, but an attack on civil rights.
