Out-of-State PAC Pressures Legislators on Right-to-Work

Remember controversial Alaska Senate candidate and tea party darling Joe Miller? He's back... and attempting to influence the vote to override Gov. Lynch's veto of so-called right-to-work legislation.

In March, Miller took over as chairman of the Western Representation PAC, a Nevada-based political action committee with strong ties to the tea party movement. Miller says the PAC, which spent over $230,000 in independent expenditures for 2010, is seeking to expand its influence.

Despite being formed fairly recently, the PAC was able to gain strong support and make an important impact during the 2010 election cycle. We plan to build on that great start and bring the voice of ‘We the People’ to bear even more as we move towards 2012.

Western PAC has now set its sights on the Granite State. Today, they offered a preview of a radio ad set to air in "targeted districts" with the goal of pressuring New Hampshire legislators to override Gov. Lynch's right-to-work veto.

The ad falsely describes the right-to-work bill as "legislation that would make it illegal to force workers to join a union as a condition of employment" and pretends to be local saying "the time has come for us in the Granite State" to enact right-to-work.

The Tea Party people don't seem to understand that they (4.00 / 2)
are being suckered. That individuals can be forced to do anything is a conservative pipe-dream. That corporations, which are creatures of the state can be forced to exercise restraint -- i.e. to not fire without consequence people who right to associate they want to deny -- is a burr under their saddle.  Setting themselves up as an artificial person is supposed to make them invincible.  Then they discover that legislators have them by the proverbial balls.

Miller was willing to use the courts to subvert the will of the voters. One might call that dangerous. I've never been so happy about a Republican (Lisa Murkowski) winning.

Wherein the truth will be told? If so, where can I go to help pay for it? Anyone know?

That's actually true. The RTW bill that the governor vetoed declared it illegal to force workers to join a union as a condition of employment. Here's the relevant text from the bill:


2 New Chapter; Right to Work Act. Amend RSA by inserting after chapter 273-C the following new chapter:

CHAPTER 273-D
RIGHT TO WORK ACT

...

EMPLOYEES FREEDOM OF CHOICE

Under the law of the state of New Hampshire, employees are protected in the exercise of their free choice to join or refrain from joining labor unions, and it is unlawful for an employer and a labor union to enter into a contract or agreement requiring them to pay dues, fees, or charges of any kind to a labor union as a condition of obtaining or keeping a job. Under this law, an employer may not discharge or otherwise discriminate against an employee because of joining or refusing to join a labor union, or to pay dues, or other charges to a labor union.

273-D:8 Coercion and Intimidation Prohibited. It shall be unlawful for any person, labor organization... by any threatened or actual intimidation of an employee ... by any damage or threatened damage to property, to compel or attempt to compel such employee to join, affiliate with, or financially support a labor organization or to refrain from doing so, or otherwise forfeit any rights as guaranteed by provisions of this chapter. It shall also be unlawful to cause or attempt to cause an employee to be denied employment or discharged from employment because of support or nonsupport of a labor organization by inducing or attempting to induce any other person to refuse to work with such employees.

273-D:9 Penalties. Any person, employer, labor organization, agent, or representative of an employer or labor organization, who directly or indirectly imposes upon any person any requirement prohibited by this chapter shall be guilty of a misdemeanor, and, ... shall be subject for each offense to a fine not exceeding $1,000, or to imprisonment not exceeding 90 days, or both.

It is illegal now, under federal law, to require an employee to join a union. That's not what this bill is about.
