I wish I were joking, but I'm not. HB 1247 was heard in the Judiciary Committee today. Here are the, um, high points.
Jurors shall consider statutes as guidelines and only guidelines.
The court must give jurors all the evidence about the case that the jurors ask for. (No exception for inadmissible evidence, folks.)
Jurors may disregard any statute or rule any statute unconstitutional.
Jurors decide penalties for every case, and may impose penalties lesser or greater than those provided in the statutes. By penalty, the death penalty is expressly included. For everything.
I'm wondering if the language of HB 1247 would also permit the jury to sentence a miscreant to a flogging, or to time in the stocks, or perhaps to demand, "Off with his head!"
