NH Chief Justice Broderick's NY Times Op-Ed

In the NY Times Op-Ed section for today (Sat, 2 January) NH Chief Justice John Broderick - a Democrat who was nominated to the NH Supreme Court by former GOP governor (and law partner) Steve Merrill - has co-written an Op-Ed essay with his counterpart on the California Supreme Court.

NYT to Gov. John Lynch: Sign HB436

The big bad NYT trains its pens on the Governor:
t is by no means a fast and easy path, but the cause of same-sex marriage is moving forward - proof that justice can triumph over wedge politics and prejudice. It happened this week in Maine and New Hampshire, where both states' legislatures voted to legalize same-sex marriage and promptly put the final say to their governors.

In New Hampshire, Gov. John Lynch - who previously defined marriage as strictly between a man and a woman - promised his "best decision" after consulting lawmakers and constituents. Mr. Lynch would be wise also to consult his neighbor in Maine, Gov. John Baldacci, who signed his state's same-sex marriage bill. He previously had opposed the idea, with the familiar hedge of supporting the half-step of civil unions.

Mr. Baldacci described his change of heart - and what we hope is the changing sentiment of many other American politicians. "I have come to believe that this is a question of fairness and of equal protection under the law, and that a civil union is not equal to civil marriage," he said. Precisely.

Me, I'd be just as happy to have him let it become law without his signature.  But it's great to see the national press paying close attention to this watershed moment.

In Spain, Water Is a New Battleground

FORTUNA, Spain - Lush fields of lettuce and hothouses of tomatoes line the roads. Verdant new developments of plush pastel vacation homes beckon buyers from Britain and Germany. Golf courses - dozens of them, all recently built - give way to the beach. At last, this hardscrabble corner of southeast Spain is thriving.

There is only one problem with the picture of bounty: this province, Murcia, is running out of water. Swaths of southeast Spain are steadily turning into desert, a process spurred on by global warming and poorly planned development.
Murcia, traditionally a poor farming region, has undergone a resort-building boom in recent years, even as many of its farmers have switched to more thirsty crops, encouraged by water transfer plans, which have become increasingly untenable. The combination has put new pressures on the land and its dwindling supply of water.

NYT calls phone-jamming "voter fraud", plus new Tobin outrage

"The Bush administration has spent a lot of time talking about mythical cases of voter fraud and election improprieties," says the editorial in today's NY Times, "but the New Hampshire phone jamming case was the real thing."

Amen!!

The Times is endorsing the recent request by Representative Paul Hodes for a Congressional investigation, citing multiple actions by the now-disgraced Department of Justice that left many avenues unexplored or even blocked.

In other phone-jamming news, James Tobin's lawyers filed a motion (on September 14) for a Judgment of Acquittal on grounds that seem to me completely outrageous...more below the fold.
