According to state law, the Supreme Court must decide if the death sentence was imposed "under the influence of passion, prejudice or any other arbitrary factor" and whether it "is excessive or disproportionate to the penalty imposed in similar cases," among other issues.

Professor Albert Scherr of the University of New Hampshire School of Law and attorney Andru Volinsky of Bernstein Shur both said the defense could argue Ayotte's e-mail introduces an "arbitrary factor" into the decision to seek the death penalty. Scherr, who is not connected to either campaign, said the defense could ask the state Supreme Court to re-examine whether the punishment was disproportionate compared with other cases or if it was politically motivated.

"If the defense can show that the only reason this was brought as a capital case and other similar cases in the state were not, simply by virtue of the fact that the attorney general's office at the time saw political advantage to bringing this as a capital case, arguably that could impact the decision," Scherr said.

And guess what?

Addison's defenders are looking into it.

Heckuva job, Kelly.  This could be a bigger - and more tragic - fail than losing at the Supreme Court and quietly paying off the winners with $300,000 of state money.

Push Poller Ayotte (4.00 / 3)
I just had the pleasure of being push-polled by a Kelly Ayotte surrogate firm identifying themselves as "Quantel". It is possible that I might occasionally try mischievously voting in the R primaries when I don't have contested D races in my district. The benefit is that I get to see all the wacky direct mail and get these ridiculous calls from Conservative pollsters.

I could almost hear the steam coming out of the guys ears as I gave him the "wrong answer" to every attempt to sway my voting. It would be hilarious, if I had any faith in the common sense of the rest of the people on the poller's call sheet

My caller was polite enough, but it was still fun to say that one of their attacks would make me "Much More Likely" to vote for Hodes.  I hope they shouldn't be surprised to learn that linking Obama & Pelosi to Hodes actually HELPS Hodes with at least Obama voters.  

I have a hunch that Mitt Romney is paying for this poll.

This is kinda scary: the person who called me was (quite possibly) being paid $7.50 an hour.  And she did not sound like a bottom of the barrel employee at all: she even pronounced Ayotte with no problem.

Don't know if you've noticed the can of worms Ginny Thomas has opened with a phone call to Anita Hill, but I want to share this comment I left at KOS because of what I hope you'll recognize as relevance. In response to a question about whether Thomas' perjured testimony at his confirmation hearing might now be held against him:
Personal ambition tends not to be considered a "conflict of interest" matter.  This is an interesting point because it's likely to come up in the matter of "absolute immunity" for prosecutors.  And is, in fact, going to be a core issue in the case that's going to the Supreme Court about whether or not John Ashcroft (also from Missouri) can be held accountable for the torture of an American citizen detained after 9/11

Liberals are very upset with the DoJ for promoting this appeal.  I think it's risky, but also very gutsy of Obama.

Many perversions of justice occur because prosecutors are, by tradition, provided with absolute immunity -- i.e. unaccountable -- and it goes to their heads.  That their own ambitions might affect how they prosecute or don't prosecute a crime tends not to be considered.  And yet, we currently have a candidate for the Senate, Kelly Ayotte, who clearly decided to seek the death penalty in a case because she thought it would advance her political ambitions.  This is an issue that's "ripe" for a SCOTUS decision.  They came close in Pottawattamie County v. McGhee, but then, when the decision looked to be adverse, the county settled the case monetarily, rather than risking a precedent.
