"Don't Touch My Junk"?

by: Jennifer Daler

I can hardly believe that a sitting state representative would name his own bill the "Don't Touch My Junk" bill, but I can less believe the editors of the UL would have put that headline there themselves.

Andrew Manuse (R-Derry) wrote an op-ed in the UL titled: Why I sponsored the TSA "don't touch my junk" bill. Here is part of the case he makes for the bill.(bold mine)

Remember, the TSA is not enforcing federal law. It is only enforcing an unconstitutional agency policy. We can tell them to stop. In reality, there is nothing the TSA can do to stop us from putting one of their agents' names on our sex offender registry. And thus, we chose this approach because it is the only thing we can do to send the message to Washington that the abuses of the TSA have got to stop, and they have to stop now.

What does Rep Manuse think should be done instead?

I think before any kind of enhanced screening is conducted, the TSA must conduct behavioral profiling and should consider using some bomb-sniffing dogs as well. If these methods result in some level of articulable suspicion, I think the next step is to use interrogation methods to further determine the level of threat.

Now I also question the full body scans, etc. in the wake of the "underwear bomber". But I am not a security expert. Surely there are other ways to voice skepticism about this policy  than to pass a state law turning airport security agents into sex offenders, and instituting  airport interrogation rooms.

Like a laser, so to speak.

Apparently I (4.00 / 2)
was unaware of the "viral" nature of the phrase, uttered by one John Tyner, of Oceanside, on refusing a TSA pat down and body scanner. Still one would thing a state representative would have more respect for his own legislation.

not surprising (4.00 / 2)
when you consider that these are the same clever folks who nicknamed a bill giving protections to transgendered folks "the bathroom bill."  They whine about civility, but left to their own devices they seem to prefer the crass and vulgar. Some third graders never grow out of wanting to shock the grown ups.

No Respect? (4.00 / 3)
Perhaps he has no respect for the NH State Legislature or the people who elected him.

[ Parent ]
More statehouse arrogance bordering on abuse of power. (4.00 / 4)
I don't like this policy, so I'll make you a sex offender.

And my solution is to start profiling.  Because terrorists like to dress up like bin Laden.

Funny how the Liberty Crowd didn't care much about these Bush era things until their demographic started getting pat downs.

Nonsense (0.00 / 0)
Dean, the 'Liberty Crowd' was doing this long before Bush was out of office.  In fact, we were at the forefront of this...

When the Tyner incident hit the media, among others, plenty of columnists pointed that out, such as Glenn Greenwald:

(that links to a number of other related columns of the time)

Strange how the tricorner hat and yellow flag phenom didn't exist (4.00 / 2)
during the various issues involving patriot act deliberations, Guantanamo, extraordinary renditions, free speech zones, Abu Ghraib, FISA, bank bailouts etc...

So odd that they would magically appear with the arrival of President Barack Hussein Obama.

Too broad a brush I think (4.00 / 1)

Plenty of very conservative and libertarian people have expressed problems with almost all of the above  from the beginning. (Bob Barr, (2008 Lib candidate for Pres.,  Ron Paul etc have opposed patiot act provisions).

What is true is that the great mass of corporate conservative republicans and the Koch created astroturf Tea groups couldn't care less about the civil liberties of anyone who doesn't belong to a country club.

"But, in the unlikely story that is America, there has never been anything false about hope." Si se puede. Yes we can.

In general, though, I don't mind giving the bill a sensationalized name. I prefer this to, say,

Operation
Iraqi
Liberty

or whatever they called it.

Mr. Manuse Doesn't surprise me (0.00 / 0)
I followed Mr. Manuse' candidacy in the last election. This doesn't surprise me. It also doesn't surprise me that voters in Derry elected him. Strange things have gone on there forever it seems

Now Chaz.... (4.00 / 1)
Robert Frost? Alan Shepard? Derry is a fine town.

Have you told a stranger today about Bill O'Brien and his Tea Party agenda? The people of NH deserve to hear about O'Brien  and his majority committed to destroying New Hampshire and remaking it into a armed survivalist preserve.

[ Parent ]
Robert Frost? (0.00 / 0)
Frost was a great poet, but he was from San Francisco.  He only lived in Derry for nine years before moving away, first to England and later to Franconia.

WMUR polling (0.00 / 0)
informal and unscientific of course... but the results are 9 to 1 in favor of this legislation... with over 10,000 votes cast.  Maybe that's skewed, but the emails in support going to Lambert and Manuse, and the negative emails going to Pantelakos are substantial, from what I understand.

The People seem to agree with this (ie DO something!), so perhaps the laser is right on target here?

False Equilivancy (4.00 / 1)
One can be against the TSA patdown/grope and against registering TSA agents as sex offenders for doing so.

I'm down with all the Bruce Schneier Security Theater stuff http://www.schneier.com/

It would seem a better approach to encourage Sens. Shaheen and Ayotte to Reps. Bass and Guinta to affect departmental policy.

If anything this will make it harder for them to do so.

Legislative theatre... (4.00 / 2)
...is what this is.

There are many ways to send a message to the TSA/Feds about procedural behavior without calling them sexual deviants in a bill that is not likely to pass anyways.

But, then, where would the media hype and sensationalism be?  And, then, how would Republicans supporting this get to appease their base?

Tactless bills like this make it harder for the TSA to be dealt with properly, indeed; but they are great for making it seem like the legislature is being productive...

or perhaps (4.00 / 3)
an unscientific poll at a right wing media outlet  is being freeped.

Tell, us Rep. Cohn, how's that laser like focus on job creation going?

[ Parent ]
I wouldn't be sure about that, Andrew (0.00 / 0)
Andrew Manuse sez:

In reality, there is nothing the TSA can do to stop us from putting one of their agents' names on our sex offender registry.

I would not be so sure about that.  I bet there are plenty of things the feds could do to stop this.

Absurd (4.00 / 3)
I don't understand these people.  Whether or not you like it or whether or not the Congress declares it, there are people out there at war with the United States.  Have we already forgotten 9/11 or that the terrorists brought weapons through the check point?

If you restrict TSA's ability to do their job eventually someone will get through and kill a lot of people.  When it happens, remember you supported this bill.

This bill is being retained, (0.00 / 0)
as are countless others.
