by: rambler american

( - promoted by Dean Barker)

Federal prosecutors have dropped charges against James Tobin in connection with the jamming of Democratic phone lines during the election of 2002. Congressman Paul Hodes, however, does not consider the case closed and insists that all the facts be aired.

How is it that Republican criminals are not prosecuted?

Look at the bright side (4.00 / 2)
Phone jamming totally screwed up the NH Republican Party for several years.

Can I ask what your legal opinion is?

DoJ (4.00 / 5)
These charges should have been brought along with the original charges against Tobin. Instead, DoJ waited until the other charges were out and the statute was about to run.

So it goes.

And I will accept karma in lieu of prosecution, but still...

TPM gets something wrong; the article linked here says,

Tobin had already been cleared in federal court in New Hampshire of taking part in a plot to arrange more than 800 hang-up calls that jammed get-out-the-vote phone lines on Election Day 2002.

That isn't true, he wasn't cleared of taking part in the plot. The court said the statute he was charged under did not apply. I'm surprised, TPM has been on top of this case since the beginning.

do you think there was prosecutorial misconduct at the Gonzo DoJ ? (4.00 / 1)
I'll take my answer off the air

Where was Hodes in Ayotte's Reappointment (0.00 / 0)
"New Hampshire's citizens deserve a full airing of what transpired in 2002," Hodes said in a written statement. "Granite Staters deserve fair elections and hopefully this case will serve as a warning to those who would seek to tamper with New Hampshire's electoral process."

Where was Hodes with the recent reappointment of Kelly Ayotte? The feds have been investigating her for two years on request of federal judge
Joseph Laplante, but not a word from Hodes. Shouldn't he have aired the issues, especially in a state where the citizens do not have have the opportunity to vote and must rely upon the "good judgment" of the governor and the Executive Council.

Lawmaker: 'Full airing' needed in Tobin case

By Andrew Miga
The Associated Press

James Tobin
WASHINGTON - A New Hampshire congressman said Wednesday he will continue to press for a "full airing," despite federal prosecutors' decision to drop their case against a GOP organizer they accused in a plot to jam Democratic phone lines in New Hampshire during the 2002 election.

Democratic Rep. Paul Hodes was responding to news that the federal government has ended its prosecution of former Republican political organizer James Tobin of Bangor.

Tobin, 48, was accused of making false statements to FBI agents investigating the plot.
